These Terms and Conditions ("Terms") govern your access to and use of TubeThreads ("Service"), operated by B van Heerden, an individual based in South Africa ("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
TubeThreads is a web-based tool that fetches publicly available data from YouTube channels via the YouTube Data API v3 and uses artificial intelligence (Claude by Anthropic) to generate short-form social media posts intended for use on Meta's Threads platform.
We provide the Service on a subscription basis with monthly generation limits based on the plan you subscribe to. All features are subject to availability and may be modified or discontinued at any time with reasonable notice.
2. Eligibility and Account Registration
You must be at least 16 years old to use the Service. By creating an account, you confirm that you meet this requirement.
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at @growwith_bianca if you suspect unauthorised access to your account. We are not liable for any loss resulting from unauthorised use of your account.
You may not create accounts using automated means or create multiple accounts for the purpose of circumventing plan limits.
3. Subscriptions and Billing
TubeThreads offers the following monthly subscription plans:
- Creator — $19.00 USD per month, 20 thread generations
- Pro — $29.00 USD per month, 35 thread generations
- Serious — $49.00 USD per month, 60 thread generations
All subscriptions are billed monthly and managed through PayPal. By subscribing, you authorise PayPal to charge your payment method on a recurring basis. Prices are stated in USD and are subject to change with at least 30 days' notice.
A "generation" means one complete 6-post thread produced by the Service for one YouTube channel analysis. Unused generations do not roll over to the next billing cycle.
4. Cancellations and Refunds
You may cancel your subscription at any time directly through your PayPal account. Cancellation takes effect at the end of the current billing period. You will retain access to the Service and your remaining generation balance until the end of the period you have paid for.
We do not offer refunds for partial months or unused generations, except where required by applicable South African consumer protection law or where we are at fault (e.g., a material service outage).
If you believe you are entitled to a refund, contact us at @growwith_bianca within 14 days of the charge.
5. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:
- Use the Service to generate content that is defamatory, misleading, harassing, or that infringes any third-party intellectual property rights
- Attempt to reverse-engineer, decompile, or extract source code from the Service
- Circumvent or attempt to circumvent generation limits, access controls, or authentication systems
- Use automated scripts or bots to interact with the Service
- Resell, sublicense, or redistribute access to the Service without our written consent
- Use the Service in any way that violates YouTube's Terms of Service, Anthropic's usage policies, or Meta's Threads Community Guidelines
We reserve the right to suspend or terminate accounts that violate these Terms without refund.
6. Generated Content and Intellectual Property
Content generated by the Service ("Generated Content") is created using publicly available YouTube data and AI models. We do not claim ownership over Generated Content. You may use, modify, and publish Generated Content as you see fit, subject to the terms of any third-party platforms (including Threads and YouTube).
You are solely responsible for reviewing Generated Content before posting. We make no representations about the accuracy, originality, or copyright status of Generated Content. It is your responsibility to ensure that any content you publish does not infringe third-party rights.
All other intellectual property in the Service — including the TubeThreads brand, interface design, and underlying code — remains the property of B van Heerden. You may not use our branding or materials without our written consent.
7. Third-Party Services
The Service integrates with and depends on third-party services including YouTube (Google), Anthropic, PayPal, Supabase, and Resend. These services are not controlled by us. We are not responsible for the availability, content, or practices of third-party services.
Your use of third-party services is governed by their respective terms of service and privacy policies.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses. We do not warrant the accuracy, completeness, or usefulness of any Generated Content.
We are not affiliated with, endorsed by, or in partnership with YouTube, Anthropic, Meta (Threads), or any creator whose content is analysed through the Service.
9. Limitation of Liability
To the maximum extent permitted by applicable law, B van Heerden shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to the Service shall not exceed the total amount you paid to us in the 3 months preceding the claim.
10. Indemnification
You agree to indemnify and hold harmless B van Heerden from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or relating to: (a) your use of the Service; (b) any Generated Content you publish; (c) your violation of these Terms; or (d) your violation of any third-party rights.
11. Governing Law and Disputes
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved by good-faith negotiation. If unresolved, disputes shall be submitted to the jurisdiction of the courts of South Africa.
If you are a consumer residing in the European Union, you may also be entitled to use the EU Online Dispute Resolution platform.
12. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes by email at least 14 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
If you do not agree with updated Terms, you must stop using the Service and cancel your subscription before the changes take effect.
13. Termination
We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. If we terminate your account without cause, we will refund any prepaid subscription fees on a pro-rata basis.
